Learned counsel appearing for the petitioner submits that the allegation against the petitioner is that the petitioner in furtherance of common intention with the co-accused persons, committed the murder of Prem Singh, who is the husband of the informant. It is then submitted that the allegations against the petitioner are all false. It is further submitted by learned counsel for the petitioner that the petitioner has been implicated in this case on the basis of suspicion and in fact, the deceased committed suicide and in the post mortem report, the doctor has opined that the cause of death was asphyxia due to strangulation. It is further submitted that there is no eye witness to the occurrence. It is next submitted that the petitioner undertakes to co-operate with the investigation of the case and also undertakes to pay Rs.1,00,000/- to the informant without prejudice to his defence, subject to final decision in the case. It is lastly submitted that the co-accused person has already been given the privilege of anticipatory bail by this Court vide order dated 05.01.2022, in A.B.A. No. 10015 of 2021. Hence, it is submitted that the petitioner be also given the privilege of anticipatory bail.
