04/ 18.10.2021 At the very outset, on instruction of his client, learned counsel for the petitioner seeks permission of this Court to withdraw the instant writ application with liberty to pursue the pending departmental appeal and further to approach this Court again by filing fresh writ application if the departmental appeal is not allowed. Learned counsel further submits that for the said purpose he has also filed I.A. No. 5865 of 2021.
Learned counsel for the respondents has no objection to the same.
In view of fair submissions of learned counsel for the parties, I.A. No. 5865 of 2021 filed for withdrawal of the writ application stands allowed.
The instant writ application is dismissed as withdrawn.
