06/17.02.2021 Heard learned counsel for the parties through V.C. 2. The instant writ application has been preferred by the petitioner praying for a direction upon the respondent authorities to give employment to the dependents of the petitioner’s husband, who is missing from Bachra Colliery area since 31.8.2008.

3. Mr. Amitabh, learned counsel for the petitioner submits that the instant writ application may be disposed of with a liberty to the petitioner to approach the concerned respondents for redressal of her grievance.

4. Mr. M.B. Lal, learned counsel appearing for the respondents fairly submits that unless and until the petitioner will produce a decree with respect to civil death of the erstwhile employee, there cannot be any employment.

5. In view of the aforesaid facts, the instant writ application is hereby disposed of by giving liberty to the petitioner to approach the concerned respondents along with the required decree with respect to civil death of the erstwhile employee for the compassionate appointment of her son.

If any such representation, along with the decree is filed; the same shall be considered in accordance with law, prevalent rules and regulations of the company within a period of four months from the date of filing of such representation.
