successful candidate has already been declared. Thus, the petitioner has no locus standi to challenge the terms and conditions of the said notice inviting application. It is further submitted that a petrol pump/retail outlet is opened by the respondent-HPCL for the convenience of public to get the supply of petroleum products which are essential commodities and any delay caused in opening the petrol pump will be contrary to the public interest. It is also submitted that serial number 112 of the said NIA was absolutely clear, proper and complete as the location of the proposed petrol pump was specifically mentioned therein and as such the claim of the petitioner that the location was not clear, proper and complete is a frivolous and baseless claim. The petitioner claims that he filed representation dated 8th January, 2019 before the respondent no.3, but in fact neither the said respondent nor any other authority ever received any such representation. The representation of the petitioner dated 19th June, 2020 was received by the respondent no.3 on 24th June, 2020 and the said respondent vide letter dated 29th September, 2020 duly replied to it. Moreover, Clause 18 of “the Brochure for Selection of Dealers for Regular and Rural Retail Outlets” dated 24th November, 2018 provides that any complaint received without attaching a demand draft of Rs. 5000/- towards requisite fee or any complaint received after 30 days from the date of draw of lots/bidding process will not be entertained by the respondent-HPCL. Since the petitioner did not make complaint within 30 days from the date of the draw of lots/bidding process which was scheduled on 19th February, 2020 and he also did not file complaint along with the requisite fee of Rs.5000/- payable through demand draft, any objection to the NIA does not deserve to be entertained at this stage by the respondent-HPCL. 5. Heard the learned counsel for the parties and perused the materials available on record. The claim of the petitioner is that the description of the location mentioned at Sl. No.112 of the notice inviting application for appointment of petrol pump dealership in the revenue district Garhwa was not clear and even after the representations dated 08th January, 2019 and 19th June, 2020, the respondent-HPCL did not cancel the process of appointment of petrol pump dealership for the said location.
