11 / 03.08.2021 This appeal is by the aggrieved wife / petitioner in Title Matrimonial Suit No. 44/2015 as the suit for dissolution of marriage invoking the grounds of cruelty and desertion under section 13(1) (ia) (ib) of the Hindu Marriage Act, 1955, has been dismissed by the impugned judgment dated 14.05.2018 and decree dated 26.05.2018. However, learned counsel for the appellant submits that the Respondent / husband has died on 02.05.2021. A supplementary affidavit has been filed by the appellant on 28.07.2021 making a categorical statement to that effect. Learned counsel for the parties submit that in the aforesaid circumstances, appeal have been rendered infructuous. Accordingly, the instant appeal is disposed of as infructuous.
