1. The present appeal has been preferred against the order dated 19.09.2020, passed by the court of learned Additional Sessions Judge – I, Lohardaga, in Misc. Cr. Application No.152 of 2020, arising out of Senha P.S. Case No.24 of 2020, corresponding to SC/ ST Case No.10 of 2020, registered for the offence under Sections 147, 148, 149, 341, 323, 307, 504, 427 of the Indian Penal Code and Sections 3(x)/ 4 of the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act (For short the SC/ ST Act), whereby the prayer for grant of bail, to the appellant, has been rejected.

2. It has been submitted by the learned counsel for the appellant that the appellant is in custody since 17.07.2020. The investigation has been completed and the appellant is ready to cooperate with the trial. The allegation has been made that the appellant has assaulted and abused the victim, who is a member of Scheduled Tribe community. It has been further submitted that the allegation is false as no reason has been assigned for assaulting and insulting the victim. On the above facts, prayer for bail of the appellant has been made.

3. Learned counsel appearing on behalf of the informant/ respondent No.02 has no objection.

Considering the fact that the investigation has been completed and further, the period of custody of the appellant, the appellant is directed to be released on bail, on his furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge – I, Lohardaga, in connection with Senha P.S. Case No.24 of 2020, corresponding to SC/ ST Case No.10 of 2020.

5. The appeal is, hereby, allowed.
