The matter was taken up through Video Conferencing. Learned counsel for the parties had no objection with it and submitted that the audio and video qualities are good.

Heard learned counsel for the appellant and learned counsel for the State. Nobody appears on behalf of the victim in spite of valid service of notice. This criminal appeal has been filed against the order dated 07.12.2020 passed by the court of learned District & Additional Sessions Judge-VI-cumSpecial Judge, SC/ST, Dhanbad in SC/ST Case No.72/2020, (M.C.A. No.1456 of 2020) arising out of Sudamdih P.S. Case No. 68 of 2020, registered for the offence under Sections 147/ 148/ 149/ 341/ 323/ 504/ 506 of the Indian Penal Code and Section 3(1)(x) of the SC/ST (Prevention of Atrocities) Act by which prayer for bail of the appellant has been rejected.

Learned counsel for the appellant has submitted that the appellant is in custody since 06.10.2020. It has been further submitted that the investigation has already been completed and the appellant is ready to co-operate with the trial. The allegation is that this appellant, along with other accused, was standing outside the Ambedkar Club and when it started raining they entered into the Club and on objection scuffle took place between the appellant and the respondent No.02 and others. It is alleged that the appellant abused and threatened the members of the Scheduled Castes and also assaulted them. It has further been submitted that the allegation is false as no offence under the SC/ST Act is made out. It has been further submitted that the co-accused, namely, Vishal Yadav @ Vishal Kumar and Vishal Nonia @ Vishal Kumar Nonia have already been granted bail by the Coordinate Bench of this Court vide order dated 23.06.2021 passed in Cr. Appeal (S.J.) No.675 of 2020 and Cr. Appeal (S.J.) No.686 of 2020. On the above facts, prayer for bail of the appellant has been made.

On the other hand, learned A.P.P has opposed the prayer and submitted that there is direct allegation against this appellant.

Having heard learned counsel for the parties and considering the fact that the investigation has been completed and the period of custody, the appellant, named above is directed to be enlarged on bail on his furnishing bail bond of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each, to the satisfaction of learned District & Additional Sessions Judge-VI-cum-Special Judge, SC/ST, Dhanbad in SC/ST Case No.72/2020, (M.C.A. No.1456 of 2020) arising out of Sudamdih P.S. Case No. 68 of 2020, subject to condition that the appellant will submit self-attested photocopy of his Aadhar Card and also submit his mobile number before the learned court below which he will always keep active and will not change it during pendency of this case without prior permission of the court.

Accordingly, instant criminal appeal is allowed.
