05/13.07.2021: The present revision application has been filed against the impugned order dated 14.02.2020 passed in Cr. Misc. Application No.146 of 2020 by the learned Chief Judicial Magistrate, Deoghar, in connection with Deoghar (Town) P.S. Case No.533 of 2019, whereby the release of Tractor bearing registration no.JH15L-4311 and a Trailor bearing registration no.JH15L-3486 has been denied. The reason for denial for releasing of the said vehicle has been assigned section 21 of the MMRD Act.

The learned counsel for the petitioner has relied upon a judgment passed by a co-ordinate bench of this Court on 03.03.2021 in Cri. Revision No.862 of 2020 in the case of Navin Kumar Choudhary vs. The State of Jharkhand , which covers the issues, raised in the present revision application. Counsel for the State could not point out any point worth consideration.

In view of the fact that the issue arisen in the present case has already been settled by a co-ordinate bench of this Court (Supra), the impugned order dated 14.02.2020 passed in Cr. Misc. Application No.146 of 2020 by the learned Chief Judicial Magistrate, Deoghar, in connection with Deoghar (Town) P.S. Case No.533 of 2019 is, hereby, quashed and the case is remitted back to the concerned court below for passing an appropriate order in accordance with law within two weeks from the date of receipt/production of a copy of this order.

With above observation and direction, the present revision application being Criminal Revision No.439 of 2020 stands disposed off.
