The matter was taken up through Video Conferencing. Learned counsels for the parties had no objection with it and submitted that the audio and video qualities were good.

03/15.07.2021 Heard learned counsel for the petitioner and the learned counsel for the State.

The instant application has been filed against the order dated 18.02.2021 passed by Sri Radha Krishan, learned Additional Sessions Judge-I-cum-Special Judge, East Singhbhum, Jamshedpur in Criminal Appeal No. 05 of 2021 by which the prayer for bail of the petitioner has been rejected in connection with Dhalbhumgarh P.S. Case No. 22 of 2019 corresponding to G.R. No. 126 of 2019 and the same is presently pending in the court of learned Principal Magistrate, Juvenile Justice Board, Jamshedpur.

It is submitted by the learned counsel for the petitioner that the juvenile petitioner is in observation home since 03.05.2019. Enquiry has almost been completed except the examination of Investigating Officer and Doctor. It has been alleged that this juvenile aged about 15.5 years, at the time of commission of crime, has committed rape upon a female child aged about 7 years. On the above facts, prayer for bail has been made.

Learned A.P.P. for the State has opposed the prayer for bail.

Considering the nature of allegation and the social investigating report and the stage of the enquiry, I am not inclined to interfere with the order of the trial Court . Accordingly, prayer for bail of the petitioner is, hereby, rejected at this stage.

However, J. J. Board, Jamshedpur is directed to conclude the enquiry within three months from the date of receipt/production of a copy of this order as only Investigating Officer and Doctor have not been examined. If enquiry is not concluded within three months, the juvenile-petitioner is at liberty to make his prayer for bail.
