The matter was taken up through Video Conferencing. Learned counsels for the parties had no objection with it and submitted that the audio and video qualities are good.

The instant application has been filed against the order dated 23.02.2021 passed by the learned AJC-I, Ranchi in Criminal Appeal (Bail) No. 03 of 2021, arising out of Tamar P.S. Case No.62 of 2020, corresponding to G.R. Case No.122 of 2021, for the offence under Section 366A/34 of the Indian Penal Code and the same is presently pending in the court of learned J.J. Board, Ranchi.

It is submitted by the learned counsel for the petitioner that the petitioner is in probation home since 18.11.2020. Investigation has already been completed and he is ready to co-operate in the trial. It has been alleged that he has kidnapped a girl aged around 16 years. It has been stated that they were travelling together and both have been recovered within four hours. It has been further submitted that father of the petitioner undertakes to keep the minor son in his proper care. On above facts, prayer for bail has been made.

Learned A.P.P. has opposed the prayer for bail and submitted that the victim girl has supported the allegation and further the social investigation report suggests that the petitioner should be away from his company as his company is not good.

Having heard the parties and from perusal of record, I am of the opinion that the petitioner should be released on bail with a condition that the father will take care of his minor son, accordingly, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned, J.J. Board, Ranchi in connection with Tamar P.S. Case No.62 of 2020, corresponding to G.R. Case No.122 of 2021 subject to condition that one of the bailor must be father of this petitioner.

Further, concerned Probation Officer is directed to report, once in a month, to the Juvenile Justice Board, Ranchi regarding the up keeping of minor.

Accordingly, instant criminal revision is allowed and the impugned order dated 23.02.2021 passed by the learned AJC-I, Ranchi in Criminal Appeal (Bail) No. 03 of 2021, arising out of Tamar P.S. Case No.62 of 2020, corresponding to G.R. Case No.122 of 2021 is, hereby, set aside.
