Heard, learned counsel for the petitioners, Ms. Alka Kumari and learned counsel for the State, Mr. Prabir Chatterjee, Special Public Prosecutor.
Learned counsel for the petitioners have prayed for grant of regular bail in connection with Patratu (Barkakana) P.S. Case No. 86/2021 for the offence registered under Sections 414/34 of the I.P.C., Section 12(i)(ii)(iii), 13 of Jharkhand Bovine Animals (Prohibition of Slaughter) Act, 2005 and Section 11(i) of Animal Cruelty Act.
Learned counsel for the petitioners has further submitted that on the allegation that petitioners were selling the beef and without any medical report regarding the material seized to be beef, the FIR has been lodged and petitioners are in custody since 23.05.2021, as such, petitioners may be enlarged on bail.
Learned counsel for the State has opposed the prayer for bail. Considering the rival submissions of the parties and looking into facts and circumstances of the case and period of custody, this Court is inclined to enlarge the petitioners on bail.
The petitioners are directed to be released on bail on furnishing bail bond of Rs. 20,000/- (Rupees Twenty Thousand) each with two sureties of the like amount each in connection Patratu (Barkakana) P.S. Case No. 86/2021 to the satisfaction of learned Chief Judicial Magistrate, Ramgarh on the following conditions: (i) One of the bailors shall be the deponent / pairvikar of the present case namely, Rustam Ansari, son of Tahur Mian, resident of

Village - Bhuchungdih, Sandi, Chittarpur, P.O. - Rajrappa Project, P.S. - Rajrappa, and District – Ramgarh, Jharkhand, who has furnished photocopy of his UID Card before this Court in the bail application.
Office is directed to send the photocopy of UID Card of deponent alongwith this order to the court below so as to verify the authenticity of the bailor .
(ii) Another bailor shall be father / mother / brother / sister / wife of the petitioners.
(iii) Petitioners shall appear before the trial court on each and every date till the conclusion of the trial.
(iv) The Jail Authority shall release the petitioners only after their medical check-up.
(v) The Civil Surgeon, Ramgarh is directed to medically examine the petitioners at the time of their release and if they are infected with corona virus, they shall be taken for quarantine, but if no such requirement is there, they shall be released forthwith, if not wanted in any other case.
(vi) The petitioners shall follow all the guidelines issued by the Government to meet the challenges of Covid-19, as presently Country is passing through pandemic of Covid-19.
Accordingly, the bail application is allowed.
