The matter was taken up through Video Conferencing. Learned counsel for the parties had no objection with it and submitted that the audio and video qualities are good.

The present application has been filed for grant of regular bail to the petitioner in connection with S.T. No.47 of 2021, Daltonganj Town P.S. Case No.24 of 2020, corresponding to G.R. Case No.690 of 2020, registered under Sections 307/ 302/ 120B/34 of the Indian Penal Code and Section 27 of the Arms Act.

It has been submitted by learned counsel for the petitioner that earlier, bail application of this petitioner has been rejected by this Court vide order dated 04.01.2021 passed in B.A. No.6143 of 2020 by observing that two persons are the witnesses to the fact that this petitioner has taken the deceased outside the house and thereafter a sound of gunshot has been heard. The said witnesses have been examined and they have declared hostile. On above facts, prayer for bail has been made.

On the other hand, learned A.P.P. has opposed the prayer.

In the attending facts and circumstances of the case, the petitioner, named above, is directed to be released on bail, on furnishing bail bonds of Rs.10,000/(Ten thousand only) with two sureties of the like amount each to the satisfaction of learned Sessions Judge, Palamau at Daltonganj in connection with S.T. No.47 of 2021, Daltonganj Town P.S. Case No.24 of 2020, corresponding to G.R. Case No.690 of 2020 subject to the conditions that the petitioner will submit self attested copy of his Aadhar Card and also give his mobile number before the learned court below which he will not change during pendency of the case without prior permission of the court.
