02/05.03.2021 Mr. Suraj Singh, learned counsel has entered appearance on behalf of opposite party no. 2. He submits that vakalatnama has been sent in soft copy. He would be filing hard copy thereof today itself.

Learned counsel for the petitioner and opposite party no. 2 submit that the matter has been compromised and a joint compromise petition has been filed which is enclosed as Annexure-2

Petitioner has approached this Court seeking anticipatory bail in terms of Section 438 Cr.P.C in connection with R.I.T P.S. Case No. 187/2020 for the offence under Section 324,307 and 506 of the Indian Penal Code and pending before the court of learned Chief Judicial Magistrate, Seraikella.

Allegation in the written report forming the basis of FIR is to the effect that accused petitioner had called the Informant to his hotel on 18.11.2020 at 8.35 pm and abused him and also attacked with Farsa with an intention to kill, as a result of which, he sustained injury.

Learned counsel for the petitioner however, submits that now the parties have entered into compromise which the learned counsel for the opposite party no. 2 also affirms on his appearance in this case. Petitioner may be granted anticipatory bail, otherwise he may suffer unnecessary incarceration upon being arrested.

Learned counsel for the opposite party no. 2 has supported the compromise petition.

Having regard to the aforesaid facts and circumstances and the compromise affirmed by both the parties, I am inclined to grant anticipatory bail to the petitioner. Accordingly, petitioner above named, in the event of his surrender or arrest within a period of four weeks, shall be released on bail on

furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Seraikella in connection with R.I.T P.S. Case No. 187/2020, subject to the condition as laid down under Section 438(2) of Cr.P.C.

Petitioner shall cooperate in the investigation. Petitioner and his bailors shall not change their address or mobile number without permission of the trial court.
