Heard the parties through video conferencing.

Apprehending his arrest in connection with Complaint Case No.761 of 2018 instituted under Sections 323, 498-A, 504, 506, 34 of the Indian Penal Code, the petitioner has moved this Court for grant of privileges of anticipatory bail.

Learned counsel appearing for the petitioner submits that the allegation against the petitioner is that the petitioner has treated the opposite party No.2 with cruelty. It is submitted that the allegations against the petitioner are all false and general and omnibus in nature. Learned counsel for the petitioner and learned counsel for the opposite party No.2 jointly submit that both the petitioner and opposite party No.2 are ready and willing to resume their conjugal life and it is agreed to between the parties that the petitioner will take the opposite party No.2 from the house of her father on 30.09.2021 and he undertakes to keep and maintain her with full honour and dignity as his lawful wife. It is lastly submitted by the learned counsel for the petitioner that the petitioner is ready and willing to cooperate with the trial of the case. Hence, it is submitted that the petitioner be given the privileges of anticipatory bail.

Learned Addl.P.P appearing for the State opposes the prayer for anticipatory bail of the petitioner.

Considering the submissions of learned counsels and the facts and circumstances stated above, I am inclined to grant privileges of anticipatory bail to the petitioner. Accordingly, the petitioner is directed to surrender in

the Court of learned Judicial Magistrate, Sahibganj on 30.09.2021 and in case the petitioners appear and surrender before the learned trial court on 30.09.2021, he will be enlarged on bail on satisfying the trial court that he has taken the opposite party No.2 from the house of her father and keeping and maintaining her with full honour and dignity as his lawful wife and on furnishing bail bond of Rs.25,000/- (Twenty five thousand) with two sureties of the like amount to the satisfaction of learned Judicial Magistrate, Sahibganj in connection with Complaint Case No.761 of 2018 with the condition that he will co-operate with the trial of the case and subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
