The Learned counsel for the petitioner submits that the allegation against the petitioner is that 80 schemes under MNREGA consisting of 1028 units in which Rs.12,91,361/- on wages and Rs.66,44,171/- on materials were to be spent for construction of shawachalaya (toilets). It is further alleged that out of the said scheme 661 shawachalaya (toilets) ought to have been completed and it should have been uploaded on SBM portal but the authorized persons till registration of the FIR completed 147 shawachalaya toilets and during the enquiry by B.D.O, most of the shawachalaya toilets, was either not completed or not constructed and hence, it is submitted that the petitioner being the Junior Engineer was responsible for embezzlement of the government money by giving false completion certificate. It is further submitted that the allegations against the petitioner are all false and the work of construction of toilets was not entrusted to the petitioner rather the Mukhiya was the executing agent.
