Learned counsel for the petitioner submits that the allegation against the petitioner is that the petitioner being the relative of the husband of the deceased Mamta Devi, has caused her dowry death. It is submitted that the allegation against the petitioner is false. It is further submitted that in the trial of the husband of the deceased vide S.T. No.48 of 2020, the father of the deceased who was examined as a witness has stated in paragraph 10 of his deposition that on being asked from the villagers of in-laws house of the deceased, they disclosed that the deceased has committed suicide herself and the PW2 in the said Sessions Trial, has also stated that the deceased committed suicide. It is also submitted that the co-accused father-in-law of the deceased has already been admitted to bail by a co-ordinate Bench of this Court vide order dated 23.10.2018 passed in B.A. No.7095 of 2018. It is next submitted that there is neither direct allegation against the petitioner nor there is any eye-witness to the occurrence and the main allegation is against the husband of the deceased.
