Learned counsel for the petitioner undertakes to remove the defects, as pointed out by the office during course of the day.

This bail application has been filed on behalf of the petitioner–Mukesh Sahu with prayer to release on bail in connection with N.D.P.S. Case No.33 of 2021, arising out of Nagri P.S. Case No.65 of 2021 registered under Sections 17/21/22 of the N.D.P.S. Act pending in the court of Principal District & Sessions Judge-cum-Special Judge N.D.P.S., Ranchi.

Learned counsel for the petitioner has submitted that the police party on secret information had apprehended the petitioner and co-accused Saroj Kumar Singh. It is further submitted that from the possession of the petitioner 2 k.g. of opium was recovered which was below the commercial quantity. The petitioner is in judicial custody since 17^th April, 2021.

Learned A.P.P. appearing on behalf of the State vehemently opposed the contentions made by the learned counsel for the petitioner but conceded that co-accused Saroj Kumar Singh has already been granted bail by this Court from whose possession, the opium below commercial quantity was recovered.

In view of the submissions made and material on record, the bail application of the petitioner is deserved to be allowed.

Accordingly, the petitioner be released on bail on furnishing bail bond of Rs.25,000/-(Rupees Twenty Five Thousand) with two sureties of the like amount to the satisfaction of the court of learned Principal District & Sessions Judge-cum-Special Judge, N.D.P.S., Ranchi in aforesaid case.
