2. Heard Mr. Ravi Prakash, learned counsel appearing on behalf of the opposite party- State of Jharkhand.

3. Learned counsel for the petitioner submits that the petitioner is in custody in connection with S.T. Case No. 285 of 2019 arising out of Hussainabad (Mahila) P.S. Case No. 15 of 2018, registered under Sections 341, 323, 304B, 201, 328, 120B, 312/34 of the IPC, now pending in the court of learned Additional Session Judge-VIII, Palamau.

Learned counsel for the petitioner further submits that although the bail application of the petitioner has been rejected twice and the trial is in progress, but the witnesses who have been examined, have not supported the prosecution case. The learned counsel submits that out of eight witnesses, three witnesses have been examined. He submits that the petitioner is in custody since 26.11.2018.

5. Learned counsel appearing on behalf of the opposite partyState, on the other hand, has opposed the prayer and has submitted that the allegation against the petitioner is very serious and the trial is in progress. He submits that the case of the petitioner was rejected

on merits twice earlier and therefore, he may not be enlarged on bail. 6. The learned counsel for the State, on behalf of the State, undertakes to produce the witnesses promptly before the learned court below as and when the date is fixed for production of witnesses. He further undertakes to communicate this order to the concerned officer of the State.

Considering the fact that the allegation against the petitioner is very serious and the bail application of the petitioner has been rejected twice and also the fact that the trial is in progress, this Court is not inclined to enlarge the petitioner on bail. Hence, this bail application is hereby rejected.

8. Let a copy of this order be communicated to the learned court below through “FAX”.
