As per factual matrix, father of the petitioner was working as peon in Nripraj High School, Seraikella. During his service period he died on 18.11.1989. The petitioner was minor at the time of death of his father so the step mother namely Tulsi Mukhiyani was appointed on compassionate ground on the post of peon in the said School. Subsequently, step mother also died during the service period on 05.11.2016 in a road accident. The petitioner claims to be one of the surviving offspring of his parents along with Sunaina and Sujata. Sunaina is a married daughter whereas Sujata is unmarried. The petitioner is claiming entitlement for appointment as he is fully dependent on his mother. A representation to that extent was filed before the authorities and the authorities after detailed enquiry found that though the petitioner is the son of the deceased but he was living separately with his wife. Admittedly, the second daughter Sujata who was unmarried is dependent on her mother and was living with her mother all along till her death. The respondents considered the case of Sujata Mukhi as her mother died in harness and Sujata Mukhi was more suitable for compassionate appointment so the case of the petitioner was rejected and Sujata
