Mr.Srijit Choudhary, the learned counsel for the appellant and Mr. Nayak, the learned counsel for the respondents submit that the file has been collected about five years back from both the counsels and in that view of the matter they are not in a position to argue this matter.

In view of the above submission of the learned counsel appearing for the parties, it transpires that the appellant has not made any alternative arrangement and as the parties have taken back the file from the learned counsels five years back and it is well within the knowledge of that if he is taking the file from the counsels appearing on their behalf, he needs to make alternative arrangement for conducting the Second Appeal.

From the record, it transpires that no alternative arrangement has been made by the appellant as well as the respondents for conducting this Second Appeal. In that view of the matter, the instant Second Appeal stands dismissed for non-prosecution.
