18/23.01.2020: In compliance of the direction passed by the Letters Patent Court appointment to the petitioner has been offered on the post of Assistant Registrar in Jharkhand Cooperative Services in pay band (II), Scale 9300 to 34,800, Grade pay 5400/-

In the affidavit dated 21.1.2020, the Additional Chief Secretary, Department of Administrative Reforms and Rajbhasa, Government of Jharkhand has produced the appointment letter dated 17.1.2020 issued under the signature of the Secretary, Cooperative Department.

Mr. Vikash Kumar, the learned state counsel submits that the order dated 4.5.2016 passed by the Division Bench in L.P.A. No. 641 of 2015 now has been complied.

In view of the affidavit dated 21.1.2020, this Contempt Case is closed.

I.A. No. 3469 of 2019 is disposed of.

This application has been filed by the applicant Jyoti Kumari for intervention in this contempt proceeding. The reason why she has filed this intervention petition has been stated in paragraph no. 3 of this application which reads as under:

“That the applicant states that in view of this Hon’ble Court’s order in L.P.A. No. 641/2016 and W.P.(PIL) No. 7525 / 2013, a press notification has been issued calling for document verification of Upendra Kumar-Physically Handicapped category candidate-OH category. I am also a physically handicapped category candidate from OH category and have received higher marks than him in the 4^th JPSC examination, but instead

of me, his name has been recommended for appointment in the OH-category.”

The grievance sought to be projected by the applicant pertains to comparative merit of Upendra Kumar viz-a-viz, the applicant, which is an issue that cannot be decided in the present contempt proceeding.

Faced with this objection by Mr. Vikash Kumar, the learned State counsel, Mrs. Vani Kumari, the learned counsel for the applicant seeks permission to withdraw this application with liberty to the applicant for availing appropriate remedy as available to her in law.

I.A. No. 127 of 2020 stands withdrawn with liberty to the applicant, as prayed for.
