1. Learned counsel for the petitioners is present.

¶14

2. Learned counsel for the opposite party submits that pursuant to order dated 19.07.2018 passed in W.P.(C) No. 402/2012, an order has been passed which has been annexed along with show-cause. He further submits that there is proposal to initiate a proceeding under Section 4(h) of Bihar Land Reforms Act, 1950 and accordingly, the compensation cannot be paid to the petitioners. The learned counsel further submits that the proceedings under Section 4(h) of the aforesaid Act of 1950 has its own procedural aspects and therefore, the present contempt proceedings be dropped.

Considering the fact that pursuant to the order passed by this Court, the authority has already taken a decision and the proceedings under Section 4(h) of the Bihar Land Reforms Act, 1950 is contemplated, therefore, this Court is not inclined to proceed with the present contempt proceedings against the opposite parties.

4. Accordingly, the present contempt proceedings is hereby dropped.

5. However, the petitioners are at liberty to take appropriate steps in accordance with law pursuant to the order which has been annexed along with the show-cause.
