The petitioner is apprehending his arrest in connection with Sadar P.S. Case No. 321 of 2019.

It has been alleged that the trucks loaded with coal were intercepted and no documents were found in the cabin. It was suspected that coal was being transported on the basis of forged document. The petitioner is the owner of truck bearing registration no. JH02AV/6589. The petitioner has brought on record the tax invoice from which it appears that plausible explanation has been given by the petitioner with respect to transportation of coal under a valid transaction.

Regard being had to the facts and circumstances of the case, I am inclined to grant anticipatory bail to the petitioner.

Accordingly, the petitioner above named is directed to surrender in the court below within four weeks and pray for bail, and in that event, he shall be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each, to the satisfaction of learned Chief Judicial Magistrate, Chatra in connection with Sadar P.S. Case No. 321 of 2019, subject to the conditions as laid down under Section 438 (2) of the Code of Criminal Procedure.
