Apprehending his arrest, the petitioner has moved this Court for grant of privilege of anticipatory bail in connection with Jamtara P. C.R. case no. 04 of 2020 registered under Sections 498A of the Indian Penal Code.

Learned counsel appearing for the petitioner and learned counsel for the opposite party no. 2 jointly submit that both the petitioner and the opposite party no. 2 are ready and willing to resume the conjugal life and the petitioner undertakes to keep and maintain the opposite party no. 2 as his lawful wife with full dignity and honour. It is further jointly submitted by learned counsel for the petitioner and learned counsel for the opposite party no. 2 that both the petitioner and the opposite party no. 2 will appear before the trial court on 23.11.2020 and on that date, the petitioner will take the opposite party no. 2 to his house giving an undertaking that he will keep and maintain the opposite party no. 2 as his lawful wife with full dignity and honour, hence, the petitioner be given the privilege of anticipatory bail.

The learned Addl. PP opposes the prayer for anticipatory bail of the petitioner.

Considering aforesaid facts and circumstances of the case, I am inclined to grant the privilege of anticipatory bail to the petitioner. Hence, in the event of arrest by the police or surrender within a period of four weeks from the date of this order, the petitioner shall be released on bail on satisfying the court concerned that the petitioner is taking the opposite party no. 2 to his house and he will keep and maintain the opposite party no. 2 with full dignity and honor as his lawful wife and on

furnishing bail bond of Rs. 25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Jamtara in connection with Jamtara P. C.R. case no. 04 of 2020 subject to the condition that the petitioner will continue to keep and maintain the opposite party no. 2 with full dignity and honor as his lawful wife till disposal of the case along with the other conditions laid down under section 438 (2) Cr. P.C.
