This writ petition has been filed under Article 226 of the Constitution of India seeking direction upon the respondents to disburse the amount under the head of Grant-in-aid for the Session 2017-18.

It is the grievance of the petitioner that the petitioner is entitled for the benefit under the law pertaining to Grant-inaid and in pursuance thereto Grant-in-aid for the Session 2016-17 was granted but without assigning any reason, Grant-in-aid has not been granted for the next Session 201718 in spite of repeated representation made in this regard. Therefore, the present writ petition.

Mr. Abhay Prakash, A.C to learned A.A.G, appearing for the respondents-State of Jharkhand has submitted that the writ petition may be disposed of giving liberty to the petitioner

to file fresh representation for its consideration by the competent authority of the State of Jharkhand.

This Court, after hearing learned counsel for the parties and with the consent of learned counsel for the petitioner, without entering into the merit of the writ petition, deem it fit and proper to dispose of the writ petition giving liberty to the petitioner to file fresh representation before respondent no. 3- Director, Secondary Education, annexing therewith all relevant documents in support of its claim, within a period of two weeks from the date of receipt of copy of this order.

Upon which, the respondent no. 3-Director, Secondary Education shall decide the same within a period of six weeks from the date of receipt of such representation.

With the liberty aforesaid, the writ petition is disposed
