Upon submission of the learned counsel for the petitioner and considering the reasons defects, as pointed out by the office, are hereby, ignored and the matter is taken up for hearing.
Heard learned counsel for the parties.
This writ petition has been preferred for the following reliefs:
“For the issuance of an appropriate writ order direction for quashing and setting aside the notice dated 02/05/2016 which was served upon the petitioner passed in Encroachment case no.– 01/2016-17 by the respondent no. 2, where by and whereunder the respondent no. 2 has noticed to the petitioner to comply the order passed within one week, under clause (C) of sub Section (1) of section 5 of the Bihar Public Land Encroachment Act, 1956 for removal of encroachment from Plot no. 499 of Area 55 x 44 of village Nawasoso, Thana no. 150 P.S.- Ratu, District- Ranchi.”
Learned counsel for the petitioner seeks permission to withdraw this writ petition with a view to approach the authority who has issued Annexure-1 to the writ petition and raise his grievance before the said authority.
Considering the submissions made, this writ petition is dismissed as withdrawn with a liberty to the petitioner to approach the authority, who has issued Annexure-1 to the writ petition, and respond to the said notice and raise his grievance.
It is made clear that this Court has not gone into the merits of this
case.
