03/ 10.07.2019 In the instant writ petition, petitioners have prayed for a direction upon the Respondents to pay the arrear of Honorarium/ Salary of the petitioners, i.e. for the period from November, 2011 to March, 2012 and July, 2012 to March, 2013 and for the period from November, 2011 to March, 2012 and from October, 2012 to January, 2013 and March, 2013, for petitioner Nos. 1 and 2 respectively.

At the very outset, learned counsel for the petitioners submits that this writ application is squarely covered by the order passed on 10.07.2017 by this Hon'ble Court in W.P.(S) No. 1916 of 2017 (Binod Kumar Choudhary & Ors. Vs. State of Jharkhand & Ors.) . Learned counsel further submits that this case may be disposed of in terms of orders passed in the aforesaid case.

Though no counter-affidavit has been filed on behalf of respondents, but learned counsel appearing on behalf of the respondents very fairly submits that issues involved in this writ petition has already been decided by the Hon’ble Court in W.P.(S) No. 1916 of 2017 and the present writ petition may be disposed of in view of order passed in above mentioned case.

In view of the fair submissions made by the learned counsel for the parties, this writ application is being disposed of in terms of the directions issued by this Hon'ble Court in W.P.(S) No. 1916 of 2017 and if the cases of the present petitioners are found to be same and similar to the case of the petitioners in W.P.(S) No. 1916 of 2017, the present petitioners are also entitled for the same benefits.

Accordingly, I hereby direct the respondent-authorities, particularly, respondent No. 5 to verify the factual aspects/ issues involved in the present writ petition vis-à-vis factual aspects/ issues involved in W.P.(S) No. 1916 of 2017 and if the facts/ issues involved in the present writ petition is found to be similar to the aforementioned writ petition, the same benefits may be extended to the present writ petitioners also, in accordance with law, within a period of four weeks from the date of receipt/production of a copy of this order

With the aforesaid observations and directions, this writ application stands disposed of.
