Heard Mr. Rohit Roy learned counsel for the petitioner and Mr. Mr.Jayant Franklin Toppo S.C(L&C) III for the State.

The petitioner has preferred this writ petition for cancellation of appointment of the respondent no. 7 as para teacher at primary school.

Mr. Rohit Roy, the learned counsel for the petitioner submits that pursuant to Aam Sabha of village Jarlahi (Muslim) Tola held on 27.2.2010, the petitioner was recommended for appointment of para teacher which was forwarded to the Block Education Committee. He further submits that inspite of the selection, he has not been provided appointment. Drawing attention of this court to the annexure-C to the Supplementary counter affidavit he submits that in agenda there is some interpolation and the name of the petitioner should have been mentioned but the petitioner's name is not there and name of the respondent no. 7 is there and the claim of the petitioner is found to be true .

On the other hand, Mr. Toppo, the learned counsel for the State submits that pursuant to the enquiry on the direction of the Deputy Commissioner, Deoghar it was found that there is some interpolation and accordingly, appointment of respondent

no. 7 had already been cancelled. Drawing attention to the annexure-C to the supplementary counter affidavit i.e Enquiry report and the chart of the persons, who have been recommended, he submits that the name of the petitioner is not found there. He further submits that the teachers are being appointed on a contract basis and much water was flown since then.

As a cumulative effect of all the facts and looking to the order of the Coordinate Bench passed in W.P(S) No. 4647 of 2010 which was disposed of on 16.4.2013, the petitioner is directed to file representation before the Deputy Commissioner, Deoghar and the Deputy Commissioner, shall consider the same after providing opportunity of hearing to the petitioner and pass a reasoned order in accordance with law within eight weeks from the date of receipt/production of a copy of this order.

With the aforesaid observation, this writ petition stands disposed of.
