This appeal has been preferred against the order dated 24.01.2017 in Original (T) Suit No.628 of 2015 passed by learned Sub-Judge-X (Sr. Division), Ranchi, where by the application filed by the appellants under order XXXIX Rule 1 & 2 read with 151 CPC has been rejected.

Learned counsel for the appellants has submitted that in view of the new notification dated 11.06.2019 vide no. LG 04/2018-252/legislative, the territorial jurisdiction, several amendments have been brought in Bengal, Agra and Assam civil Courts A of 1887 (Act 12/1987) in its application to the State of Jharkhand whereby sub-section 1 of section 19 has been substituted by Rs.5 lacs instead of Rs.50,000/- and sub-section 2 has been substituted by Rs.7 lacs instead of Rs.1 lac as well as section 21 wherein Rs.25 lacs has been substituted instead of Rs.2, 50,000/-. As such in view of such amendments the present miscellaneous appeal is not maintainable before this Court and same may be remitted to the learned Judicial Commissioner, Ranchi.

Accordingly, this appeal is disposed of with liberty to the appellants to prefer an appeal before the learned Judicial Commissioner, Ranchi.

Learned Judicial Commissioner, Ranchi shall consider the same and condone the delay if any.
