Learned counsel for the appellants has submitted that impugned order has been passed refusing the injunction prayed by the appellants being the plaintiffs before the learned Court below under order 39 Rules 1 and 2 read with Section 151 of the Code of Civil Procedure in Original Suit No.141 of 2018 vide order dated 08.06.2018.

Learned counsel for the appellants has submitted that since a substantial time has already been lapsed and as such, instead of making such prayer, it would be proper for him that learned Trial Court may be directed to expedite the Trial. Learned counsel for the State, Ms. Moushmi Chaterjee appearing for J.C. to Mr. Atanu Banerjee, S.C.-III has no objection.

Considering the rival submissions of the parties, since the appellants has not pressed the injunction petition at this stage, considering the long delay and has made prayer for disposal of the Tittle Suit, this Court directs the learned Tribunal to expedite the disposal of Tittle Suit No.141 of 2018 as expeditiously as possible without giving any unnecessary adjournment in the matter.

Accordingly, the Miscellaneous Appeal is disposed of.
