Learned counsel for the petitioner submits that the petitioner is a juvenile. He further submits that the allegation against the petitioner and others is that they have committed theft the house of the informant, but he submits that nothing has been recovered from the possession of the petitioner. He further submits that there is no eye witness to the said occurrence and only material against the petitioner is that he has confessed his guilt. He lastly submits that the petitioner, aged about 16 years, is in custody since 5.2.2019.

Learned A.P.P opposes the prayer of the petitioner but has not controverted the aforesaid submission.

Considering the fact that the petitioner is a juvenile, aged about 16 years, and taking into consideration the period of his custody, I am inclined to release the petitioner on bail. Accordingly, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees ten thousand) with two sureties of the like amount each to the satisfaction of the learned Juvenile Justice Board, Deoghar, in connection with Deoghar (Town) P.S. Case No. 508/2018 (corresponding to Enquiry No. 98/2019); with a condition that one of the the bailors must be his father with further condition that an affidavit will be filed by his father that he would not allow his son to have association with the criminals.

Accordingly, this petition is allowed .
