Heard the learned counsel for the parties.
The petitioner has been made an accused for committing an offence under section 419 and 420 IPC and Section 66(B)/66( C) IT Act.
Counsel for the petitioner submits that petitioner is a juvenile and in fact he has been made scapegoat by the other accused persons. He submits that bank fraud/ cyber offence, has been committed by his family members but since petitioner is a juvenile, he has also been implicated in this case. On instruction counsel for the petitioner submits that he is ready to deposit the entire amount which is Rs. 89800/- before the court below. He further submits that petitioner is in custody since 12.02.2019.
Considering the fact that petitioner is a juvenile and the period of custody and he is ready to deposit the said amount, I am inclined to release the petitioner on bail. Accordingly, petitioner above named is directed to be released on bail, on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each of the satisfaction of the Juvenile Justice Board, Latehar in connection with Chandwa P.S. Case No. 7 of 2019, corresponding to G.R No. 193 of 2019 subject to the condition that one of the bailers must be the father of the petitioner, who will file an affidavit to the effect that he would not allow his son(petitioner) to have association with criminals. Further condition that petitioner at the time of filing his bail bonds, the amount should deposit before the court below a sum of Rs. 90,000/- (Ninety thousand). The said amount will not be disbursed to any person without obtaining order from this Court.
This Criminal Revision Application is, accordingly, allowed.
