07/07.03.2019 An affidavit has been filed on behalf of the Superintendent of Police, Gumla on 22nd February 2019 in compliance of our order dated 24th January 2019. As per the chart at para-2 containing the status of the appellants, it is indicated that appellant Maikel Oraon alias Maikel Xaxa has died on 28th November 2018. His death certificate is also enclosed. No leave has been sought in terms of Section 394 Cr.P.C. by any legal heir/close relatives of the deceased appellant within 30 days of the death of the appellant, therefore, Cr. Appeal (DB) No. 169 of 1996 abates as respects appellant Maikel Oraon alias Maikel Xaxa.
As per the affidavit of the Superintendent of Police, Gumla, the other two appellants in each of the two appeals are alive. Therefore, the appeals survive as respects the surviving appellants.
