“That by way of this Interlocutory application, the petitioners are challenging the final report / charge sheet bearing no.11/2011 dated 29.01.2011, filed in connection with F.I.R. No. RC -04 (A) 2010-D dated 25.01.2010 under Section 420, 468 & 471 of the I.P.C., while considering the fact that the C.B.I who in the FIR had alleged regarding entering of the authorities of BCCL into a criminal conspiracy with 7 Nos. of non-existing / non-manufacturing / suspect Companies/ Firms by allotting them linkage quota of coal at subsidized rate which allegedly got diverted in open market at higher price by them have surprisingly and to the utter shock and surprise to the petitioners not charge sheeted the said two authorities of B.C.C.L.”
