for O.P. No.02 and the learned A.P.P that no medical examination or injury report had been produced to substantiate the allegation of the offence under Section 377 I.P.C. It transpires that there is no material on record to substantiate the allegation to constitute the offence under Section 377 I.P.C. Now, since both the parties have amicably settled the dispute and have also filed the petition under Section 13B of the Hindu Marriage Act for divorce on mutual consent, therefore, taking into account that O.P. No.02 does not want to proceed further with the prosecution of the case, consequently continuance of proceeding further in connection with Bank More P.S. Case No.227 of 2018 will be an exercise in futility resulting in wastage of time and an abuse of the process of Court. Thus, for the ends of justice, the compromise is accepted. Accordingly, the entire criminal proceedings in connection with Bank More P.S. Case No.227 of 2018, pending in the court of learned Chief Judicial Magistrate, Dhanbad is, hereby quashed, in view of the compromise.
