It has been stated in the supplementary counter affidavit dated 27.02.2019 filed on behalf of the respondents which has been sworn by the Deputy Superintendent of Police (Headquarter), CID, Ranchi denying the allegation made by the petitioner that his son was killed in a false police encounter. It has been averred in the said counter affidavit that as per the direction of the National Human Rights Commissions, the investigation of the cases were taken over by an independent agency i.e. the CID. During the investigation, the hand swabs of the deceased persons (three in numbers including late Nilesh Kumar Singh) were taken and sent to the Forensic Science Laboratory, Jharkhand, Ranchi which submitted its report on 19.08.2011 disclosing that traces of Barium, Antimony and Lead were found to be higher on the right hand swabs of the deceased persons thereby giving opinion that fire arms were used by them using their right hands. Apart from that, the Sub-Divisional Officer, Dhalbhum also conducted a magisterial inquiry into the said occurrence as per guidelines of the National Human Rights Commission, in which it was found that there was an encounter between the police team and three miscreants as they tried to kill the owner of the “Hotel Friendship Inn” – Upendra Singh. The CID after investigation submitted the final form stating that the allegation against the deceased-accused persons was found true but the allegation made against the police personnel was found false.
