This criminal miscellaneous petition has been filed at the instance of the petitioner for restoration of A.B.A. No. 1964 of 2018 to its original file.
Heard the parties.
It is submitted by the learned counsel for the petitioner that A.B.A. No. 1964 of 2018 was listed on 10.01.2019 but the learned counsel for the petitioner left the Court because her daughter was ill after instructing Mr. Avishek Prasad Advocate to appear on her behalf but Mr. Avishek Prasad was on legs before Court No.16 and when this case was called out he could not appear, resulting in dismissal of the said A.B.A. No. 1964 of 2018 for its nonprosecution. It is further submitted that unless the said A.B.A. No. 1964 of 2018 is restored to its file, the petitioner will be highly prejudiced.
The learned counsel for the opposite party no.2 submits that the opposite party no.2 has been harassed because of negligence of the petitioner; hence she should be compensated in terms of money.
The learned counsel for the petitioner tenders Rs.1,000/- to the learned counsel for the opposite party no.2 which he receives in Court.
Considering the aforesaid submission of the learned counsel for the petitioner, the prayer for to restore A.B.A. No. 1964 of 2018 to its original file is allowed.
List A.B.A. No. 1964 of 2018 on 05.04.2019 before the appropriate Bench.
This criminal miscellaneous petition is disposed of accordingly.
