03/17.01.2019 At the outset, learned counsel for the petitioners Mr. Parth S.A. Swaroop Pati has submitted that he does not want to press this application, so as to raise all these points at the time of filing of discharge petition.
Learned counsel for the State assisted by learned counsel for the Opposite Party No. 2 have no objection.
Accordingly, both the petitions are dismissed as withdrawn. However, the learned court below will not be prejudiced because of withdrawal of these petitions and will look into the merit of the case and decide the case on the basis of the pleadings of the petitioner at the appropriate stage including at the stage of filing of the discharge petition.
