05 / 05.04.2019. Heard learned counsel appearing for the petitioner and learned A.P.P. for the State.

The petitioner, who is an accused for the offence under Section 11 (1)/(a)/(b)/ (c)/(d)/(e)/(f)/(h)/(i)/(k) of the P.C.A. Act and under Sections 47, 48, 49, 50, 51, 52, 54, 56(c) of Transport of Cattle Rules, under Sections 3/ 4, 4(a), 4(b), 4(c), 4(d)/ 5, 12(1), (2), (3), 13, 15, 16 of JBAPS, 2005 and under Sections 3, 4(a), 4(b) of the B.P. and I.A. Act, prays for regular bail in connection with Complaint Case bearing C.P. Case No.2932 of 2015 .

Learned counsel appearing for the petitioner has submitted that the petitioner is in custody since 07.01.2019 and he is not claiming the cattle and owner of the vehicle has already been granted anticipatory bail by a Co-ordinate Bench of this Court.

At the outset, learned counsel for the petitioner has submitted that the petitioner is ready to deposit Rs.50,000/- as a cost to feed the cattle and he will appear on each and every date before the learned trial court till conclusion of the trial.

Considering the rival submission of the parties and considering that the petitioner is ready to deposit Rs.50,000/- before the District Animal Husbandry Department, Dhanbad, as such, the petitioner, above-named, is directed to be released on regular bail, on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Dhanbad, in connection with Complaint Case bearing C.P. Case No.2932 of 2015 and subject to the condition that the petitioner shall show a receipt of Rs.50,000/- before the District Animal Husbandry Department, Dhanbad and subject to the further condition that the petitioner shall appear on each and every date before the learned trial court till conclusion of the trial, failing which, the learned trial court shall cancel the bail bonds of the petitioner.

However, the deposit of Rs.50,000/-, shall not prejudice the case of the petitioner.
