The petitioner is an accused in a case registered under Sections 25(1-A), 25(1-B)a, 26 and 35 of the Indian Penal Code.

Learned counsel for the petitioner submits that the petitioner has been falsely implicated in the present case and has committed no offence as alleged. As per the case of the prosecution, the police while investigating Nagri P.S. Case No.93 of 2017 raided the house of coaccused- Tulsi Dasa Korah, wherein the petitioner and other co-accused persons were found sitting. There is alleged recovery of one loaded country made pistol along with two live cartridges from the possession of the petitioner. It is further submitted that, in fact, no recovery has been made from the conscious possession of the petitioner and he was forced to sign on a blank paper, which was later on used as seizure list. The petitioner has been remanded in the present case on 15^th October, 2018 i.e. after lapse of about one year of the date of the alleged recovery. As such, the petitioner who is in judicial custody since 15^th October, 2018 in the present case may be given the privilege of regular bail.

Learned APP opposes the petitioner's prayer for bail.

Considering the facts and circumstances of the case, I am inclined to enlarge the petitioner, above named, on bail. Accordingly, the petitioner is directed to be released on bail on furnishing bail bond of Rs.20,000/- (rupees twenty thousand) with two sureties of the like amount, each, to the satisfaction of learned Chief Judicial Magistrate, Chaibasa, in connection with Goilkera P.S. Case No.34 of 2017, corresponding to G.R. No.299(S) of 2017.
