The petitioner is an accused in a case registered for the offence punishable under Sections 25(1-A)/26/35 of Arms Act, Sections 3/4 of Explosive Substance Act and Section 17 of C.L.A Act.

Learned counsel for the petitioner submits that the petitioner has been falsely implicated in this case and has not committed any offence as alleged. The petitioner has not been arrested by the police at the spot. The name of the petitioner surfaced on the basis of the alleged disclosure made by the arrested co-accused. Except the said fact, the police has not collected any cogent evidence against the petitioner to connect him with the alleged offence. The petitioner is in judicial custody since 18.03.2019 and as such he may be given the privilege of regular bail.

Learned A.P.P opposes the petitioner’s prayer for bail.

Considering the aforesaid facts and circumstances of the case, I am inclined to enlarge the petitioner on bail. Accordingly, the above named petitioner is directed to be released on bail on furnishing bail-bond of Rs.20,000/- (twenty thousand only) with two sureties of the like amount each to the satisfaction of the Judicial Magistrate, 1^st Class, Ranchi in connection with Chanho P.S. Case No. 115/2018, corresponding to G.R. No. 53/2019, subject to the condition that the petitioner shall co-operate in the trial and shall be present before the Trial Court on each and every date, unless his physical presence for a particular date is specifically exempted by the order of the Trial Court, failing which the Trial Court is at liberty to pass appropriate order against the petitioner in accordance with law.
