04/15.07.2019 Heard the learned counsel for the parties.
The petitioner is an accused for the offence punishable under Sections 420/272/273/34 of the Indian Penal Code and Section 47(A) of the Excise Act.
The learned counsel for the petitioner submits that the petitioner has been falsely implicated in the present case and has not committed any offence as alleged in the F.I.R. The petitioner is the driver of the vehicle from which 9 cartoons of IMFL and 11 plastic sacks containing pouches of country liquor were allegedly recovered. The petitioner has no concern with the said recovered liquor as he was carrying the same on the instruction of the owner of the vehicle. The petitioner is in judicial custody since 10.05.2019 and as such, he may be given the privilege of regular bail.
The learned A.P.P. opposes the petitioner's prayer for bail.
Considering the facts and circumstances of the case, I am inclined to enlarge the petitioner on bail. Accordingly, the petitioner above named is directed to be released on bail on furnishing bail bond of Rs.20,000/- (Rupees Twenty thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Bokaro, in connection with B.S. City P.S. Case No. 94 of 2019.
