The Learned counsel for the petitioner submits that the allegation against the petitioner is that petitioner entered into an agreement with Jai Prakash Gupta, Ranjan Kumar Verma and Jugal Kishore to sell a land and has taken an advance of Rs.12,50,000/- but is not repaying the said amount. It is next submitted that the allegation against the petitioner are false and only Rs.4,00,000/- has been received by the petitioner. Drawing attention of this Court to page no.32 of the brief, it is next submitted that one of the cheque of Rs.1,00,000/- has been dishonoured by the bank. It is further submitted that the petitioner has not received any cash amount from any of the said three persons and the alleged acknowledgement of receipt of the said amount as claimed to have been mentioned behind the back of the first page of the said agreement by the informant party is forged and neither the back page of the first page of the agreement bears the signature of the petitioner nor his hand writing is appearing upon it. It is next submitted that the petitioner is ready and willing to pay Rs.4,00,000/- equally to the three members of the informant
