7/06.12.2019 Heard learned counsel appearing for the petitioner and the learned counsel for the State, who opposes the prayer for bail of the petitioner.
The petitioner is an accused for allegedly committing offence punishable under Sections 147, 148, 149, 353, 307 of the Indian Penal Code, Section 25(1-b), 26, 35 of the Arms Act, Section 17 C.L.A. Act and Sections 4/5 of the Explosive Substance Act.
Counsel for the petitioner submits that the petitioner is in custody since 07.09.2017. He submits that though there is allegation of firing and counter firing, but none got injured. He further submits that similarly situated other co-accused has been granted bail by Coordinate Benches of this Court in B.A. Nos. 9983 of 2016 & 11790 of 2013.
Considering the period of custody and the fact that similarly situated co-accused have been granted bail, I am inclined to enlarge the petitioner on bail. Accordingly, petitioner namely, Lala Singh @ Raju is directed to be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Sessions Judge, Latehar in connection with Manika P.S. Case No. 87 of 2012 [G.R. No. 613/2012, S.T. No. 194(S)/2016], subject to the condition that the petitioner shall appear before the Officer-in-Charge, Manika Police Station, Latehar once in a month and shall mark his attendance. If he fails to appear in any particular month, his bail bonds shall stand cancelled and the Officer-in-charge would be at liberty to arrest the petitioner.
