The Learned Senior Advocate appearing for the petitioners submits that the allegation against the petitioners is that the petitioner no.1 by misrepresenting himself to be the owner of the Gupta Auto Mobiles has given the possession of the said showroom in the name and style of Gupta Auto Mobiles and misappropriated the sale proceeds of 23 motorcycles. It is further submitted that the allegations against the petitioners are all false and the petitioner no.1 is the brother of Krishna Mohan Sah (since deceased) who was the owner of the Gupta Auto Mobiles and after the death of Krishna Mohan Sah, the petitioner no.1 inherited the ownership of the said Gupta Auto Mobiles and prior to the institution of the compliant, the petitioner no.1 through his Advocate issued a notice to the complainant to pay Rs.30,00,000/and as a counter blast, to avoid the said payment, this false case has been foisted by the complainant.
