Apprehending their arrest, the petitioners have moved this Court for grant of privilege of anticipatory bail in connection with Adityapur P.S. Case No.144 of 2018 (G.R. No. 605 of 2018) registered under sections 147/149/323/325/307/504/506 of the Indian Penal Code.
Heard the learned counsel for the petitioners and learned Addl. P.P. for the State.
The Learned counsel for the petitioners submits that the petitioners and the informant were students of the same college and because of some misunderstanding, the occurrence took place and with the intervention of some of their well-wisher, they have amicably settled their dispute outside the court and good sense has prevailed between the parties. Learned counsel for the petitioner further, drew the attention of this court to page no. 24 of the brief which is the copy of the certified copy of the compromise petition filed before the court of Sessions Judge, Seraikella – Kharsawan and submitted that in view of the compromise effected to between the parties, the petitioner be given the privilege of anticipatory bail.
Learned Addl. P.P. submits that in view of the compromise effected to between the parties he has no serious objection for grant of anticipatory bail to the petitioners.
Considering the submissions of the counsels and the fact as discussed above, I am of the opinion that it is a fit case where the above named petitioners be given the privilege of anticipatory bail. Hence, in the event of their arrest or surrender within a period of four weeks from the date of this order, they shall be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty Five Thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Seraikella, in connection with Adityapur P.S. Case No.144 of 2018 (G.R. No. 605 of 2018) subject to the conditions laid down under section 438 (2) Cr. P.C.
