The learned counsel appearing for the petitioner submits that the allegations against the petitioner is that the petitioner has provided truck to the informant for transporting articles which did not reach to its destination. It is then submitted that the allegations against the petitioner are all false. It is next submitted by learned counsel for the petitioner that the alleged truck which did not reach to its destination, was not supplied by Jai Maa Ambay Transport of which the petitioner is the proprietor. Drawing attention of the court to page 13 at paragraph 3 of the brief, it is submitted by learned counsel for the petitioner that the said vehicle was supplied on 17.08.2018 whereas the annexure 1 of the counter affidavit shows that the date of loading is of 18.08.2018 and there is cutting and overwriting of the truck number in the annexure-1 and the signature is neither of the petitioner or any of his employee, hence, it clearly goes to show that the said document is not related to the present consignment in respect of which this FIR has been lodged. It is further submitted that though the informant claims to have paid an advance of Rs. 32,005/- but annexure 2 at page 12 of the counter affidavit shows that the payment was made on 18.08.2017, whereas the consignment was on 17.08.2018 so this document is
