T. S. Case No. 19/1981 was instituted before the Sub-Judge-1, Seraikella by the private respondents on behalf of the villagers for declaration of their right, title and possession including the easementary right in respect of the tank situated over the said land. The Sub-Judge-I, Seraikella rejected their claim of title over the said land, however, they were given easementary right for certain specified purposes. The petitioner has filed application for fixation of rent for the said land under due process of law showing his right, title and interest over the said property declared by the civil court, however, the respondent authorities are sitting tight over the same. It is further submitted that the order passed by the Additional Deputy Commissioner, West Singhbhum, Chaibasa in Revision Miscellaneous Appeal no. 4/91 was in favour of the petitioner, as the appeal preferred by Mahendra Nath Mahto and others was dismissed with clear stipulation that the private respondents have only the easementary right over the said land. The order passed in Revision Miscellaneous Appeal no. 4/91 was also confirmed by the Commissioner, South Chotanagpur Division, Ranchi in Singhbhum Revenue Revision No. 183/1993.
