08/02.02.2018 In the instant writ application, the petitioner has, inter alia, prayed for a direction to the respondents for payment of promotional benefits of the Second time bound promotion with effect from 1987 alongwith the interest.

Heard Mr. Uday Kant Thakur, learned counsel for the petitioner, Mr.Chandrashekhar Singh, learned J.C. to Sr. S.C. III, appearing for the Respondent-State as well as Mr. Sudarshan Shrivastava, learned counsel for the Respondent No. 4.

Repudiating the contentions made in the writ application, a supplementary counter affidavit, dated 10.01.2018 has been filed, wherein, it has been, inter alia, submitted that in pursuance to the Resolution No. 10770, dated 30.01.2081, provisions for Junior Selection grade and Senior Selection grade has been made and vide letter dated 18.12.1984 provisions for Junior Selection grade and Senior Selection grade have been given effect from 01.04.1981. The petitioner, who was working as an Assistant Teacher in basic post matric trained pay-scale i.e. Rs.580-10-620-15-770-15-860, was also given promotion in Junior Selection grade @ 29 per cent of the basic post of Matric trained in the pay-scale of Rs.680-15-890-E.B.-15-965 on the basis of seniority of the petitioner. Again the petitioner has been promoted in Senior Selection Grade, which is 10 per cent of the matric trained post in the pay-scale of Rs.730-15-820-20-980-E.B.20-1080/- and after retirement of the

petitioner, the pension of the petitioner has been fixed on the 50 per cent of the last pay drawn, as evident from Annexure-B to the supplementary counter affidavit. It has further been submitted that since the petitioner is governed under the Elementary Schools Teachers, who have its separate promotional avenues, the petitioner is not entitled for grant of time bound promotion, such as, the 1st A.C.P., 2nd A.C.P. and the M.A.C.P.

After hearing the learned counsel for the respective parties and on perusal of the records and the supplementary counter affidavit, it appears that the grievance of the petitioner has already been redressed and nothing survives to be adjudicated upon in the present writ application.

Accordingly, the writ petition stands disposed of.
