03/10.07.2018 The present writ petition has been filed for issuance of direction upon the respondents to pay the admitted dues to the petitioner for the work executed by him under PMGSY scheme, Phase No. VIII, Package No. JH-0539 and routine maintenance.

Learned counsel for the petitioner submits that pursuant to the NIT issued by the Jharkhand State Rural Road Development Authority under PMGSY scheme, the petitioner participated in the tender and on getting successful, he was allotted the work under PMGSY scheme, Phase No. VIII, Package No. JH0539 and of routine maintenance for five years at the contract price of Rs.1,47,49,648/- (for construction Rs.1,36,01,638/- + for maintenance Rs.11,48,010/-). An agreement was also executed to that effect. The petitioner carried out the said work as per the final extension granted to him vide letter dated 28.06.2017 issued under the signature of the Chief Engineer, J.S.R.R.D.A, Ranchi. The grievance of the petitioner is that an amount of Rs.13,87,222 (Rs.5,98,194 for construction + Rs.7,89,028 for maintenance) has not yet been paid to him, though the bills to that effect have already been prepared by the concerned Junior Engineer.

Having heard learned counsel for the parties and looking into the contents of the present writ petition, the petitioner is given liberty to prefer a fresh representation regarding his claim before the respondent No.3 along with the supporting documents. On receipt of such representation, the respondent

No.3, after verifying the relevant records, shall take appropriate decision in this regard within a period of 12 (twelve) weeks from the date of receipt of the said representation. If the petitioner’s claim is found justified, the admitted amount shall be released in his favour within a period of 8 (eight) weeks thereafter.

The present writ petition is accordingly disposed of with the aforesaid liberty and direction.
